TERMS AND CONDITIONS 2019
Details of our Terms and Conditions are always sent to you when you make a booking. You will be asked to sign a booking form stating that you have read, understand and accept terms and conditions of Climb-Outside. Please do take the time to ensure this is the case.

1. Bookings and Payments
1.1 All places must be reserved by us receiving a completed booking form (by email or post) AND 50% deposit. (100% of the course fee within 4 weeks of the start of the course). A confirmation of your course booking will be made by email or post.
1.2 The balance of the course fee is payable 6 weeks prior to the course commencement date. In the event that the balance is not paid, we will have the discretion to treat the booking as cancelled by the client and re-sell the course place.
1.3 Deposit and balance may be paid by direct credit / electronic banking (BACS) or by cheques payable to Hannes Bonitz. Please ask for account information if choosing to pay by direct debit / electronic banking (BACS).
1.4. All courses are exempt of VAT.
1.5 We do not hold an A.A.L.A licence and as such do not operate with unaccompanied under 18’s. We are able to work with under 18’s provided a parent or legally appointed guardian is present. This does not, at this time, include school groups or scout groups. Certain activities fall out of the scope of the A.A.L.A. scheme and may be offered to under 18’s.
2. Cancellation by Client
We understand that circumstances can change but we also feel that we are entitled to a fair notice of cancellation, because we might have turned down other work for your booking.
2.1 All cancellations must be made in writing (email or post).
2.2 Climb-Outside will always try to re-sell the course once we have been notified of the cancellation in writing
2.3 In the event that the course is resold prior to the commencement of the course, the client will receive a full refund less 20% admin cost.
2.4 In the event that the course is not resold prior to the commencement of the course, the client will be charged the following cancellation fees:
2.4.1 50% of the total paid where cancellation takes place up to 6 weeks prior to the commencement of the course;or
2.4.2 75% of the total course fee where cancellation takes place less that 4 weeks before the commencement of the course;or
2.4.3 100% of the total course fee where cancellation takes place within the final 2 weeks before the commencement of the course.
2.5 Refunds will only be made after the commencement date of the course.
2.6 Under certain circumstances dates can be changed and deposits/full payments may be held in credit in respect of future alternative dates.
2.7 A postponement is ultimately a cancellation and a re-booking.
2.8 To cover the eventuality of a cancellation, we recommend an insurance policy that includes cancellation or curtailment of your trip/holiday. Please see our FAQ page for information on a small selection of suitable insurance companies.
3. Amendments
3.1 Substitution of the original customer for another can be made provided the substituting customer satisfies the requirement of the course. All substitutions must be made with the consent of the company with both the substituted and substituting customer being jointly and severally liable for the total course fee.
3.2 A customer may apply, in writing, to change course or course dates. If it not possible to change course dates, the request will be dealt with as under terms and conditions 3.
4. Cancellation by Climb-Outside
4.1 Every attempt is made to ensure that courses run as scheduled. In the event of a course needing to be cancelled due to unforseeable circumstances, clients will be noticed as soon as possible.
4.2 In the unlikely event of a cancellation by us we will:
4.2.1 Offer a total refund of any monies paid.
4.2.2 Offer alternative dates.
4.2.3 Make arrangements with another provider on your behalf.
4.3 We reserve the right to either cancel outright or remove individuals from any course at any time due to inappropriate behaviour, suspicion of participants being under the influence of alcohol or drugs, lack of suitable clothing, uncompleted consent forms or lack of group supervision by accompanying parent(s)/guardian(s)/staff/leader(s), deliberate misuse and neglect of equipment. Any losses or damage caused to equipment by the wilful actions of an individual will be invoiced to the person, body or organisation booking activities on that persons behalf.
4.4 In the event of the cancellation of a course under circumstances laid out under 4.3, there will be no refunds.
5. Exceptional circumstances
In circumstances where cancellation may be necessary such as extreme weather conditions or access restrictions placed on the public such as foot and mouth in 2001 a fair solution will be agreed between parties. Personal insurance against cancellation is recommended.
6. Risk and Dangers
6.1 Whilst we maintain high professional standards of client care and safety, outdoor activities are inherently dangerous and the risk of serious injury or death cannot be completely eliminated. We take every care to ensure the safety of both clients and ourselves to minimise risk and we have an excellent safety record. However, clients should be aware of the risks involved and should take responsibility for their own actions. We therefore draw your attention to the Participation Statements of the British Mountaineering Council (BMC).
'...Hill walking and mountaineering are activities with a danger of personal injury or death. Participants in these activities should be aware of and accept these risks and be responsible for their own actions and involvement.'
When booking on any of our courses you must understand and accept the BMC's participation statements.
6.2 All party members will be required to adhere to any safety requirements and instructions we set down, without exception and inclusive of any accompanying friend(s), parent(s), guardian(s) or leader(s). Climb-Outside will not be liable for any injury or death as a result of not following my safety requirements and instructions.
6.3 We will not take responsibility for any uninsured losses or damage to property.
7. Insurance
All instructors at Climb-Outside are fully insured for Public Liability. You can download the company's liability insurance certificate here. It is recommended that all participants are covered by some form of travel and personal insurance; normally these policies cover cancellation, personal accident and personal liability. Please see our FAQ page for information on a small selection of suitable insurance companies.
8. Additional Costs
Use of private facilities & additional hire or access will be passed on at cost unless agreed with course leader e.g. ropes courses, climbing walls, mini bus hire etc.
9. Data
9.1 We will never pass your information onto other companies or agencies without your permission.
9.2 We may contact you with special offers or to keep you informed about our services from time to time. Please tell us if you wish to opt out.
9.3 Booking Forms will be kept by me for a minimum of 12 months.
